Ohioans Vote to Protect Reproductive Rights

In a momentous decision, Ohio voters have chosen to amend their state constitution to enshrine the right to abortion and protect other reproductive rights. This landmark move makes Ohio the sole state to directly address abortion access this election cycle, and its outcome is reverberating across the nation as a crucial indicator of voter mobilization for abortion rights in the run-up to the 2024 presidential election.

The victory achieved in Ohio continues the successful streak of abortion rights advocates, who have proactively pursued opportunities to bring this vital issue directly before voters. This strategic approach includes constitutional amendments and ballot measures, particularly following the U.S. Supreme Court’s decision to overturn Roe v. Wade last year. In seven states, including Ohio, abortion access has been put to the vote. In each case, anti-abortion rights groups have faced defeat.

President Biden hailed this decision as a “win” for democracy, underscoring the importance of safeguarding women’s health and access to care. He expressed his concerns about extreme abortion bans that have the potential to endanger women’s lives, impose significant travel burdens for care, and even threaten healthcare providers with criminalization.

The passage of this constitutional amendment in Ohio marks a significant turning point, preventing the reinstatement of a state law that bans abortion once fetal cardiac activity is detectable, which can be as early as six weeks into pregnancy. A county court had suspended this law a year ago following a lawsuit by doctors, arguing that it put some women’s lives at risk, despite its exception for cases where the mother’s life was in jeopardy.

The legal battle had escalated to the Ohio Supreme Court, where three justices openly opposed abortion rights. The constitutional amendment settles the matter, affirming the right to choose and access reproductive healthcare.


 

The campaign surrounding this amendment was fierce, with advertisements dominating the airwaves. Ohio’s Republican Governor, Mike DeWine, a vocal opponent of the amendment, appeared in an ad criticizing the measure as “not right for Ohio.” However, Ohio voters voiced their views through the democratic process, making a resounding statement about their support for reproductive rights.

This critical vote comes on the heels of a Republican effort to change the state’s constitution, requiring a 60% threshold for passing constitutional amendments, which ultimately failed. Opinion polls consistently show that around 55% to 58% of Ohioans support some form of abortion rights, reflecting the will of the majority.

In addition to the reproductive rights amendment, Ohio voters also weighed in on the legalization of marijuana in the state, with results available separately.
